Agreement to Terms

By accessing or using the services provided by Desert Cities Information Technology ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Desert Cities Information Technology provides professional services as described on our website. The scope, timeline, and deliverables for any engagement will be defined in a separate written agreement or statement of work signed by both parties. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Payment

Payment terms for services are outlined in your individual service agreement. You agree to pay all fees as specified. Late payments may be subject to a late fee or suspension of services. All fees are non-refundable except as expressly stated in your service agreement.

Client Responsibilities

You agree to provide accurate and complete information necessary for us to deliver our services. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

Intellectual Property

Unless otherwise agreed in writing, all work product created by Desert Cities Information Technology for you becomes your property upon receipt of full payment. We retain the right to use your project in our portfolio and marketing materials unless you request otherwise in writing. Our pre-existing tools, templates, and methodologies remain our property.

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement and not to disclose such information to third parties without prior written consent, except as required by law.

Limitation of Liability

To the fullest extent permitted by law, Desert Cities Information Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. Our total liability to you shall not exceed the total fees paid by you in the three months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will meet your specific requirements or that results will be error-free or uninterrupted.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Maricopa County, Arizona.

Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the effective date above. Continued use of our services after changes constitutes acceptance of the revised Terms.
